N° MD11-J-2013-000853 Vista la anterior solicitud de Divorcio 185-A del C.C. de fecha 14/10/2013, suscrita por los cónyuges PEDRO RAMON RONDON Y ELIZABETH NIÑO MARQUEZ, venezolanos, mayores de edad, titulares de las cédulas de identidad N° V-14.171.530; V-14.172.629, respectivamente, padres de los adolescentes y niños se omiten , de 16, 12 y 10 años de edad; debidamente asistidos por los abogados CARLOS ALBERTO GONZALEZ RIVERO, INPREABOGADO N° 191.331; Y por celebrada la Fase de Sustanciación de la Audiencia Preliminar en fecha 28/11/2013, inserta al folio 24, ESTE TRIBUNAL PRIMERO DE PRIMERA INSTANCIA DE MEDIACIÓN, SUSTANCIACIÓN Y EJECUCIÓN, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPÚBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, DECLARA CON LUGAR la acción interpuesta y en consecuencia declara disuelto el vínculo matrimonial que unía a los cónyuges PEDRO RAMON RONDON Y ELIZABETH NIÑO MARQUEZ, desde la fecha 02/05/2006, según Acta N° 97, expedida por la Prefectura de la Parroquia Corazón de Jesús Barinas Estado Barinas, conforme el artículo 375 LOPNNA, en cuanto al cumplimiento del deber de Manutención de las hijas habidos en el matrimonio, se medió y homologó ALCANZANDOSE ACUERDOS TOTALES EN CUSTODIA,OBLIGACION DE MANUTENCION Y REGIMEN DE CONVIVENCIA FAMILIAR DE LA SIGUIENTE MANERA: CUSTODIA LA EJERZA LA MADRE; CONTRIBUCION DE OBLIGACION DE MANUTENCION A CARGO DEL PADRE: MONTO MESUAL DEMANDADO DOS MIL CUATROCIENTOS BOLIVARES (BS.2.400,00) MONTO MENSUAL MEDIADO DOS MIL CUATROCIENTOS BOLIVARES (BS.2.400,00) PARA CUBRIR LOS GASTOS DE ALIMENTACION DE LOS NIÑOS Y ADOLESCENTES, MONTO ADICIONAL DEMANDADO PARA EL MES DE AGOSTO TRES MIL DOSCIENTOS BOLIVARES (BS. 3.200,00) MONTO ADICIONAL MEDIADO COMO CONTRIBUCION PARA COMPRA DE UNIFORMES Y UTILES ESCOLARES TRES MIL DOSCIENTOS BOLIVARES (BS.3.200,00) PAGADEROS EN AGOSTO DE 2014, MONTO ADICIONAL DEMANDADO PARA COMPRA DE ESTREÑOS NAVIDEÑOS TRES MIL DOSCIENTOS BOLIVARES (BS. 3.200,00) MONTO ADICIONAL MEDIADO COMO CONTRIBUCION PARA COMPRA DE ESTRENOS NAVIDEÑOS TRES MIL DOSCIENTO BOLIVARES (BS.3.200,00); EN CASO DE UNA CONTINGENCIA MEDICA EL PADRE CUBRIRA 50% DE GASTOS MEDICOS Y RECREACIÓN; DICHOS MONTOS SERAN DEPOSITADOS EN CUENTA BANCARIA DE LA MADRE; EN CUANTO AL REGIMEN DE CONVIVENCIA FAMILIAR AMPLIO EN FAVOR DEL PADRE E HIJOS YA QUE EL PADRE SE LO PUEDE BUSCAR DOS FINES DE SEMANAS AL MES LOS DIAS VIERNES Y REGRESARLOS AL HOGAR LOS DOMINGOS EN LA TARDE DOS VECES AL MES, EL DIA DEL PADRE LO PASARA CON EL Y EL DIA DE LA MADRE CON LA MADRE EN CUANTO A LAS VACACIONES ESCOLARES UNAS CON EL PADRE Y LA OTRA CON LA MADRE; EN CARNAVALES CON EL PADRE Y EN SEMANA SANTA CON LA MADRE ALTERNANDO EN LOS AÑOS SIGUIENTES; EL 24 DE DICIEMBRE CON SU PADRE Y EL 31 CON SU MADRE ALTERNANDO EN EL AÑO SIGUIENTE YA QUE LA MADRE NO OBSTACULIZA SUS ENCUENTROS AFECTIVOS PERMANENTES, VISTOS LAS ANTERIORES EXPOSICIONES Y ACUERDOS EN FAVOR DE LOS NIÑOS Y ADOLESCENTES INVOLUCRADOS. SE DECLARA QUEDA EXTINGUIDO EL VINCULO CONYUGAL. Remítase copia certificada de la presente decisión a las Autoridad del Registro Civil correspondiente conforme ordena el artículo 03 numeral 2do de la Ley Orgánica de Registro Civil. Expídanse las copias certificadas solicitadas. En la ciudad de Barinas a los (02) días del mes de Diciembre de 2.013. Años 203° de la Independencia y 154° de la Federación.
